Last updated: 14 October 2026

These terms apply to every quotation we give and every order we accept for monitoring equipment, installation, engineering services and the cloud monitoring platform. Please read them before you accept a quotation. If anything is unclear, contact us at info@aquaiot.co.uk or on 02392 233611 before you order.

AQUAIOT LTD is a company registered in England and Wales, company number 16585190. Our registered office is Technology House, Units 10-11 Stratfield Park, Elettra Avenue, Waterlooville, Hampshire, PO7 7XN, United Kingdom. In these terms, we, us and our mean AQUAIOT LTD.

2. Definitions

  • Customer or you: the business, organisation or person named on our quotation or order confirmation.
  • Goods: the equipment, sensors, gateways, parts and documentation we supply.
  • Services: installation, commissioning, site surveys, engineering, training, support and any other work we carry out.
  • Platform: the AQUAIOT cloud dashboard, alerts, reports, data storage and connectivity we provide for the Goods.
  • Contract: the agreement between you and us for the Goods, Services or Platform, made up of the accepted quotation and these terms.
  • In writing: includes email and acceptance through our online quotation page.

3. Quotations and orders

  1. Our quotations are valid for 30 days from the date shown on them, unless the quotation says otherwise. We may withdraw or change a quotation before you accept it.
  2. A Contract is formed when you accept our quotation, either online by entering your details and accepting it on our quotation page, or in writing, or when we confirm your purchase order in writing.
  3. The person who accepts a quotation confirms that they are authorised to place the order on behalf of the Customer.
  4. These terms apply to the exclusion of any other terms, including terms printed on or referred to in your purchase order, unless we agree otherwise in writing.
  5. Once accepted, a quotation is fixed. Any change to quantities, scope or delivery needs a revised quotation from us.

4. Prices and payment

  1. Prices are in pounds sterling and exclude VAT, which is added at the rate in force at the date of invoice. Delivery is charged as shown on the quotation.
  2. Account customers pay within 30 days of the invoice date. Other customers pay a proforma invoice before we despatch the Goods or start the Services.
  3. Platform and connectivity fees are invoiced in advance for the period shown on the quotation.
  4. If a payment is late, we may suspend deliveries, Services and access to the Platform until it is paid, and we may charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.

5. Delivery and risk

  1. We deliver to the address on the quotation or order confirmation. Delivery dates are estimates; we will tell you promptly if a date is going to move.
  2. Risk in the Goods passes to you on delivery. Please check the Goods and tell us in writing of any damage or shortage within 5 working days of delivery.
  3. If you cannot accept delivery on the agreed date, we may store the Goods and charge reasonable storage and redelivery costs.

6. Ownership

The Goods remain our property until we have received payment in full for them. Until then you must keep them in good condition and identifiable as ours, and we may recover them if payment is overdue.

7. Installation and site work

  1. Where we install or commission equipment, you agree to give our engineers safe, timely access to the site, a named contact, and the information we reasonably need, including asbestos registers, permits, confined space and other site safety requirements.
  2. Quotations for installation assume the site is as described to us. Extra work caused by site conditions we were not told about, aborted visits or delays outside our control may be charged at our standard rates after we have told you.
  3. You are responsible for any permissions needed from landlords, utilities or other third parties to install equipment on the site.

8. The Platform, data and connectivity

  1. We provide access to the Platform for the period you have paid for. We aim to keep it available at all times but cannot guarantee uninterrupted service, because it relies on mobile, LoRaWAN and internet networks run by third parties.
  2. Monitoring, alerts and reports support your own management of water assets and risk. They do not replace your legal duties, inspections, sampling, maintenance or the advice of a competent person, and using them does not on its own make you compliant with any regulation.
  3. Readings depend on the equipment being installed, powered and maintained correctly. Please act on alerts promptly and tell us if a device stops reporting.
  4. You own the measurement data from your sites. We process it to provide the Platform and as described in our privacy policy. You may ask for an export of your data at any time during the Contract and for 30 days after it ends.
  5. You must keep your Platform login details confidential and must not use the Platform unlawfully or try to access other customers’ data.

9. Warranty and returns

  1. Goods carry the manufacturer’s warranty, details of which are available on request. We will repair, replace or credit Goods that prove faulty within the warranty period through normal use.
  2. Before returning anything, contact us for a return authorisation number. We will inspect returned Goods before deciding on repair, replacement or credit.
  3. The warranty does not cover damage caused by incorrect installation by others, misuse, modification, accidents, flooding beyond the product’s rating, or normal wear such as batteries.
  4. Services are carried out with reasonable skill and care. If you believe work was not, tell us within 30 days and we will put it right.

10. Cancellation

  1. You may cancel an order before despatch or before work starts by telling us in writing. We may charge for costs already incurred, including Goods ordered specially for you, which cannot be returned.
  2. Platform subscriptions run for the term shown on the quotation and then continue month to month until either party gives 30 days’ notice in writing.

11. Liability

  1. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
  2. We are not liable for loss of profit, revenue, business or goodwill, or for any indirect or consequential loss.
  3. Our total liability under or in connection with a Contract is limited to the price paid for that Contract in the 12 months before the claim.
  4. We are not liable for delay or failure caused by events beyond our reasonable control, including network outages, extreme weather, supply shortages and actions of third parties.

12. Intellectual property

All rights in the Platform, software, firmware, reports templates and documentation remain with us or our licensors. You receive a licence to use them for your own business for as long as the Contract lasts.

13. Consumers

We mainly supply businesses and public bodies. If you buy from us as a consumer, these terms do not affect your statutory rights, including those under the Consumer Rights Act 2015 and, for orders made at a distance, your right to cancel within 14 days under the Consumer Contracts Regulations 2013.

14. General

  1. We may update these terms from time to time. The version on this page when you accept a quotation applies to that Contract.
  2. If any part of these terms is found unenforceable, the rest remains in force.
  3. These terms and any Contract are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
